Oral Order: The Unopposed Motion to Redact Portions of the September 23, 2020, Discovery Dispute Hearing Transcript (D.I. 214 ) is DENIED. The court finds that the discussion in the transcript of material contained in a non-privileged letter to Celsee investors and information related to Bio-Rads acquisition of Celsee was done in a generalized manner without revealing specifics. The court further finds that the extent of the proposed redactions renders it impossible to discern the nature of the underlying dispute or the resultant bench ruling. The Third Circuit has held that a party's vague assertions that the transcript contains secretive business information, and that disclosure would render [it] at a tactical disadvantage are insufficient to overcome the strong presumption in favor of public accessibility. See In re Avandia Mktg., Sales Practices & Prods. Liab. Litig., 924 F.3d 662, 676 (3d Cir. 2019). Consequently, it is not enough to say that the parties marked something highly confidential, nor is it enough to assert in conclusory fashion that the proposed redacted material relates specifically to proprietary information. See id. Furthermore, the parties have not shown how an unredacted transcript would result in competitive harm to Celsee. See id. at 678-79 (holding that allegations of competitive harm must be supported by current evidence and must amount to more than mere embarrassment.). The court stays the filing of the unredacted transcript on the public docket until the expiration of the Objections period under Fed. R. Civ. P. 72(a) and a ruling upon Objections, if any.
