ORAL ORDER: In the Scheduling Order issued today, the Court declined Defendant's proposal for a "super-early" limited Markman hearing. The Court's decision was based in part on scheduling concerns. However, it was also based in part on the lack of information presented by Defendant, prior to the date of the Case Management Conference, explaining why this type of early Markman hearing would be beneficial. Armed only with the limited discussion regarding this issue that occurred at the Case Management Conference, the Court is not fully convinced that the use of the District Court's resources for a "super early" limited Markman hearing is warranted here.
