ORAL ORDER: The Court HEREBY ORDERS an in-person discovery dispute hearing and scheduling conference in Civil Action Nos. 22-605, 21-1699, 21-977, and 23-239 on Friday, October 4, 2024, at 10:00 am, in Courtroom 6B. The agenda for the hearing will be as follows:Civil Action Nos. 22-605/21-1699 (1) Discovery Hearing to resolve the discovery dispute identified in D.I. 812 filed in Civil Action No. 22-605 (relating to Abbott's request for an extension of the rebuttal expert report deadline which is currently October 9, 2024). With respect to this discovery dispute, Abbott shall file its opening letter brief, which shall be three (3) pages or less, by no later than 5:00 pm ET on September 26, 2024. DexCom shall file its answering letter brief, which shall be three pages or less, by no later than 5:00 pm ET on September 30, 2024. The parties shall deliver to Chambers two (2) courtesy copies of their respective letter briefs with hard tabs inserted before exhibits.(2) Discovery Hearing to hear and resolve any other currently pending discovery dispute that the parties have already met and conferred about and previously requested a discovery teleconference, prior to September 24, 2024, that remains unheard. With respect to any such disputes, any party seeking relief shall file its opening letter brief, which shall be three (3) pages or less, identifying the dispute, setting forth its position on the dispute and the supporting authority for its position, by no later than 5:00 pm ET on September 26, 2024. The party opposing the relief sought shall file its answering letter brief, which shall be three pages or less, setting forth its position on the dispute and the supporting authority for its position, by no later than 5:00 pm ET on September 30, 2024. The parties shall deliver to Chambers two (2) courtesy copies of their respective letter briefs with hard tabs inserted before exhibits. (3) Scheduling Conference to discuss status of discovery, what discovery and other pretrial matters remain before trial, and the parties' joint proposed amended scheduling order. The parties shall meet and confer prior to the hearing and, on or before October 2, 2024, at 5:00 pm ET, submit for the Court's consideration a joint proposed amended scheduling order, consistent with the applicable scheduling order of Judge Gregory B.
