MINUTES OF PROCEEDING: ORDER - A telephone conference was held on September 20, 2017, to consider Defendant Skechers' request to modify the Stipulated Protective Order 50 in this case. For the reasons stated on the record, Skechers' request is GRANTED IN PART. The Stipulated Protective Order 50 is modified so as to not preclude Skechers from filing with the PTAB in the related and pending IPR proceeding any of the following three documents: (a) ADISPG0004005 et seq.; (b) ADISPG0004072 et seq.; and (c) the transcript from the deposition of Christopher Murphy taken on September 2, 2016 [70-1], subject to the following three conditions: (1) Skechers shall ensure that, if filed, such documents are subject to a protective order in the PTAB proceeding that provides protections similar to those contained in the Stipulated Protective Order 50 ; (2) to the extent that Skechers files any of these three documents with its IPR reply brief or discusses any of them in its IPR brief, Skechers shall not oppose any motion that may be filed by adidas with the PTAB seeking leave to file a sur-reply that is limited to adidas' response to Skechers' discussion of any of these three documents; and (3) this Order is without prejudice to adidas' right to file a motion to exclude any of these three documents from consideration by the PTAB in the pending IPR proceeding, which motion Skechers may oppose.
