ORAL ORDER: Having reviewed Beckman's motion for leave to file a sur-reply in opposition to BD's motion for a preliminary injunction (D.I. 78 ) and the corresponding briefing (D.I. 83 ; D.I. 84 ), the Court GRANTS the motion. Beckman should be afforded the opportunity to respond to an infringement theory (with an attendant inherent claim construction position) that was not included in BD's opening brief and which could not have been anticipated from that brief. As for BD's expressed concern about "unfair uncertainty about the scope of the substantive arguments at the upcoming hearing" (D.I. 83 at 2), this ruling should alleviate that concern. The Court is not otherwise persuaded that the filing of the sur-reply is unfairly prejudicial to BD. Beckman shall file its proposed Sur-Reply (D.I. 78, Ex. 1) on the docket today.
