ORAL ORDER: Having considered the parties' Joint Status Report (D.I. 46), IT IS HEREBY ORDERED that the parties shall brief the patent eligibility of any patent claims on which Blix may or does wish to proceed and any whose eligibility Apple wishes to challenge (which may mean up to 37 more claims must be briefed and assessed) according to the following schedule: (a) by January 8, the parties shall meet and confer and agree on which claims the Court must determine eligibility of; (b) by January 22, Apple files its opening brief, up to 20 pages, to dismiss claims based on Section 101; (c) by February 5, Blix files its answering brief, up to 20 pages; and (d) by February 12, Apple files its reply brief. IT IS FURTHER ORDERED that Blix shall file an Amended Complaint by no later than February 12, 2021, in which Blix shall amend only the allegations with respect to its antitrust claims, and which shall also include language adopting the patent allegations of the presently-operative complaint (D.I. 13). The Court agrees with Apple that "Blix already amended its patent causes of action under Rule 15(a)(1), Blix never moved under Rule 15(a)(2) for a second amendment, and the Court did not grant Blix the right to amend its Patent cause of action in its Order." (D.I. 46 at 2) IT IS FURTHER ORDERED that the parties shall, after the filing of the forthcoming amended complaint, meet and confer and, no later than February 26, submit a joint status report advising the Court of whether Apple will be moving to dismiss some or all of the amended antitrust claims and/or how the parties propose to proceed.
