ORAL ORDER: Having reviewed the parties' letters and related materials (D.I. 58, 59), IT IS HEREBY ORDERED that Defendant's request for production of unredacted versions of five responsive documents Plaintiff has only produced in redacted form is GRANTED. Redactions for relevance and for confidentiality are not warranted, at least under the circumstances of this case, where the full context of the documents appears likely to be relevant and given the protective order that has been entered. Plaintiff's request to modify the protective order is unpersuasive, particularly given the adverse impact it could have on Defendant's choice of counsel, which is not warranted. REDACTED VERSION of 96 Letter, by Citrix Systems Inc.. (Kraft, Denise) (Entered: 10/11/2018)

ORAL ORDER: Having reviewed the parties' recent filings (D.I. 89-90, 96-98), IT IS HEREBY ORDERED that: (1) Workspot's motion to strike (D.I. 89) Citrix's reply brief is DENIED; and (2) Workspot's alternative request for leave to file a sur-reply, take additional discovery, and extend the date for the preliminary injunction hearing is GRANTED. The Court is not persuaded by either side's arguments. Workspot invites the Court to dissect Citrix's reply brief - which, by agreement, was filed after Citrix took discovery - to precisely delineate which arguments are proper rebuttal or supplementation and which are purportedly improper new theories. In the context of this case, where a preliminary injunction motion has been pending for more than five months, undertaking such a task would not promote the just, speedy, and inexpensive resolution of the parties' dispute. See generally F.R.C.P. 1. On the other hand, Citrix's contention that it would be unfairly prejudiced by a short continuance of the preliminary injunction hearing, and further contention that Workspot's earlier position with respect to scheduling essentially permits Citrix to do whatever it wants in a reply brief and foreclose Workspot from taking limited additional discovery in order to fairly respond, lack merit. The Court will be in the best position to assess both sides' evolving positions by permitting Workspot to proceed consistent with its alternative proposal. IT IS FURTHER ORDERED that Workspot's sur-reply brief is due December 12 and oral argument on the preliminary injunction motion will be heard on December 19 at 10 a.m., with each side having one (1) hour for its presentation. ORDERED by Judge Leonard P. Stark on 10/16/18. (ntl) (Entered: 10/16/2018)

ORAL ORDER: Having reviewed Magistrate Judge Fallon's Memorandum Order of March 28, 2019 ("Order") (D.I. 197), Workspot's Objections to the Order (D.I. 203), and Citrix's Response (D.I. 208), and further having reviewed the emails representative of the parties' disputes in camera and applying the applicable standards of review, IT IS HEREBY ORDERED that Workspot's Objections are OVERRULED. The Order applied the correct standard for the crime-fraud exception ("CFE") to the attorney-client privilege, including by finding that certain emails were sent "in furtherance of" an intended crime or fraud (notwithstanding a few references to the fact that these emails also "related to" a crime or fraud, which is a fact although not dispositive). The Order's finding that the CFE applies because the "emails address the Chawla declaration itself and/or the investigations by Citrix and Workspot into the harassing emails" (D.I. 197 35) was not clearly erroneous. The Order's fees and costs determinations were properly based on the not clearly erroneous findings that, under the circumstances of this case (in particular, the complexity and extent of discovery, briefing, and oral argument necessitated by the filing of a false declaration), the 600 hours expended and rates charged by DLA attorneys were reasonable. Workspot's objections with respect to the non-DLA attorneys were not presented to Judge Fallon and are waived. Workspots objections to the Order's reference to a "law enforcement proceeding" lack merit; no persuasive basis has been stated for asking the Court to micromanage language used by another judicial officer. The referral of discovery disputes to Judge Fallon remains in effect and shall govern throughout the remainder of this proceeding in the absence of any further order of the Court, even in the event that further objections are filed and during the pendency of any such objections before Judge Stark. ORDERED by Judge Leonard P. Stark on 8/9/19. (ntl) (Entered: 08/09/2019)

ORAL ORDER: Having reviewed Citrix's unopposed motion (D.I. 158) for redaction of the transcript of the hearing held on December 12, 2018, and Citrix's proposed redactions (D.I. 159), IT IS HEREBY ORDERED that Citrix's motion is GRANTED. The information Citrix seeks to redact, which relates to the contents of an apparently fabricated email, implicates little legitimate public interest and may be substantially and unduly prejudicial to Citrix and to the non-parties named in the email. The Court therefore finds good cause to enter Citrix's redactions. See Publicker Indus., Inc. v. Cohen, 733 F.2d 1059, 1071 (3d Cir. 1984). ORDERED by Judge Leonard P. Stark on 8/14/19. Joint STATUS REPORT by Citrix Systems Inc.. (Biggs, Brian) (Entered: 03/24/2020)
2020-03-24
1
ORAL ORDER: Having reviewed the parties' joint status report (D.I. 342), and in recognition of the challenges counsel and their clients (as well as the Court) confront given the ongoing coronavirus pandemic, the Court agrees to continue the claim construction hearing. However, the Court sees no need to continue argument on the sanctions motion until such time as a hearing can be safely conducted in the courtroom. Instead, the Court will provide a brief continuance of the argument on the sanctions motion, to provide additional time for counsel to prepare, and will give counsel more time for argument than it would in the courtroom. With these accommodations, the Court is confident that each side will have an opportunity to be fully and fairly heard in connection with the sanctions motion during a teleconference. Accordingly, IT IS HEREBY ORDERED that: (1) the April 6 courtroom hearing is CANCELLED; (2) the Court will hear argument, by teleconference, on the motion for sanctions on Wednesday, April 15 at 10:00 a.m., with each side allocated one hour for its argument; the parties shall submit electronic versions of any slides/demonstratives/powerpoint they intend to use by no later than Tuesday, April 14 at 4:00 p.m.; (3) the claim construction hearing will be held, in the courtroom, on Tuesday, May 26, at 1:00 p.m., with each side allocated one hour for its presentation; and (4) the parties shall meet and confer and, no later than April 3, submit a joint proposed amended schedule, taking into account the delay in the claim construction hearing. For the teleconference on April 15, the parties can access the teleconference by dialing 877-336-1829 and using the access code 1408971. ORDERED by Judge Leonard P. Stark on 3/27/20. ORAL ORDER: Having considered the parties' filings concerning Citrix's motion for leave to amend (see D.I. 331-32, 341, 344), IT IS HEREBY ORDERED that Citrix's motion (D.I. 218) is GRANTED. The motion is timely as it was filed by the deadline provided in the then-operative scheduling order and Workspot has not shown Citrix failed to act diligently. See Fed. R. Civ. Proc. 15(a)(2) (providing "court should freely give leave when justice so requires" unless party opposing leave demonstrates undue delay, prejudice, bad faith, dilatory motive, or futility); Arthur v. Maersk, Inc., 434 F.3d 196, 204 (3d Cir. 2006). Citrix seeks to add allegations relating to the same alleged statements by Workspot that have long been in the case. Workspot has failed to show that permitting the new allegations will cause undue prejudice to it. Nor will the Court permit a motion to strike (as suggested by Workspot); Workspot's concerns can be raised in connection with case-dispositive motions. Citrix also seeks to add an affirmative defense and counterclaim alleging that inequitable conduct renders Workspot's '182 patent unenforcable. Citrix has stated a plausible case of inequitable conduct (see, e.g., D.I. 331 at 3), so the amendment is not futile; nor has any other meritorious basis to deny it been articulated. ORDERED by Judge Leonard P. Stark on 9/25/20. (ntl) (Entered: 09/25/2020)

ORAL ORDER: Having reviewed the parties' recent letters (see D.I. 426, 432), and in consideration of recent developments in this case and the needs of this case (see, e.g., D.I. 432) and mindful of the limitations resulting from the Court's other commitments and its limited ability to conduct jury trials under present circumstances (see District of Delaware's Jury Trial Restart Guidelines, Oct. 7, 2020; see also Standing Order re: Criminal and Civil Jury Selections; Jury Trials; and Transition to Phase 2, Sept. 1, 2020 ("[I]t is anticipated that the Court will conduct no more than one jury trial at a time and will give priority to criminal trials.")), the Court has determined that it is no longer reasonable and appropriate to keep this case on track for the scheduled trial date of May 10, 2021. Accordingly, IT IS HEREBY ORDERED that all existing dates and deadlines are VACATED and the following schedule SHALL govern: (i) briefing on summary judgment and Daubert briefs to be concluded by April 16, 2021; (ii) hearing on summary judgment and Daubert on May 4, 2021 at 1:00 p.m.; (iii) proposed pretrial order due on July 23, 2021; (iv) pretrial conference to be held on July 30, 2021 at 9:00 a.m.; and (v) a jury trial of 5 to 10 days to begin on August 9, 2021. IT IS FURTHER ORDERED that: (a) the parties shall meet and confer and, not later than October 23, submit a proposed scheduling order including the foregoing dates and deadlines and any others that either party requests (e.g., fact and expert discovery-related deadlines); and, (b) any sanctions-related disputes are REFERRED to Judge Fallon (see D.I. 412 at 3; D.I. 426 at 5). ORAL ORDER: Having considered Workspot's motion for partial reconsideration (D.I. 425) of the Court's claim construction ruling (D.I. 401, 402) and Citrix's response (D.I. 442), IT IS HEREBY ORDERED that Workspot's motion (D.I. 425) is DENIED. Motions brought pursuant to Local Rule 7.1.5 are "sparingly granted" and require the moving party to demonstrate "(1) a change in controlling law; (2) a need to correct a clear error of law or fact or to prevent manifest injustice; or (3) availability of new evidence not available when the judgment was granted," a standard which is "difficult to meet." MobileMedia Ideas, LLC v. Apple Inc., 966 F. Supp. 2d 433, 437 (D. Del. 2013); see also Fed. R. Civ. P. 59(e). Workspot has failed to meet its burden as none of the constructions (Terms 3-5, 7, 9-12) it challenges in its motion are the result of "a clear error of law" (the only grounds Workspot identifies in its motion). Workspot largely, and improperly, rehashes the same arguments the Court has already considered and rejected. (See, e.g., D.I. 401 at 6-8) Workspot's request for additional guidance concerning Terms VII-IX is without merit, as explained by Citrix. (See D.I. 442 at 8) (pointing to D.I. 401 at 28 n.4) Ordered by Judge Leonard P. Stark on 11/20/2020. (etg) (Entered: 11/20/2020)
