ORDER denying as moot 15 Defendant's Motion to Dismiss for Failure to State a Claim. Plaintiff filed a second amended complaint on March 18, 2016, without asking leave to do so. Despite this procedural irregularity, defendant does not object to the court granting leave to amend retroactively. The court believes this is the most efficient way to address the matter, so in the interest of justice, the court grants plaintiff leave to file the second amended complaint, effective March 18, 2016. The deadline to respond to the second amended complaint remains April 1. Defendant's pending motion to dismiss (Doc.) 15 is denied without prejudice as moot, based on the filing of the second amended complaint. Signed by District Judge Carlos Murguia on 3/29/16.
