ORAL ORDER: Having reviewed Plaintiff DivX, LLC's motion to stay pending final determination by the ITC in Investigation No. 337-TA-1222 (D.I. 30 ) and the submissions filed in connection therewith (D.I. 33 ; D.I. 34 ; D.I. 37 ; D.I. 45, Ex. A), the Court GRANTS the motion. This case is in its infancy and the Court has not yet entered a scheduling order. A related case and claims against another defendant in this case have been stayed. (See D.I. 15 ; No. 20-1203, D.I. 11.) The ITC case is set for trial next month. The Court finds that this action and the pending ITC case have sufficient overlapping factual and legal issues such that there is a potential for significant simplification of this litigation, notwithstanding that one of the two patents-in-suit (which share a common disclosure) is not at issue in the ITC case. The Court does not find that a stay will cause undue prejudice to Realtek. While granting a stay might postpone the resolution of Realtek's pending motions before this Court (including its pending Section 101 motion (D.I. 43 )), the Court does not find such delay to be unduly prejudicial, particularly since the issue of the validity of the '486 patent is before the ITC; Realtek's inability to obtain a ruling on its Section 101 motion from this Court prior to the ITC's determination does not constitute undue prejudice. Accordingly, IT IS HEREBY ORDERED that all proceedings in this action are stayed pending the final determination of the ITC in Investigation No. 337-TA-1222. Realtek's motion for leave to file a sur-reply in opposition to Plaintiff's motion to stay (D.I. 45 ) is GRANTED. ORDERED by Judge Jennifer L. Hall on 6/3/2021. (ceg) (Entered: 06/03/2021)
