MINUTES OF Continued Discovery Hearing held before Magistrate Judge Shashi H. Kewalramani: The Court held a continued informal discovery dispute conference regarding discovery requests propounded by Defendant on Plaintiff related to information from cases where the same patents-in-suit being asserted in this case are being asserted against other defendants ("Related Cases"). Attorney Brian Hill appeared on behalf of the Plaintiff and attorneys Justin Gillett appeared on behalf of the Defendant. The parties notified the Court that the dispute regarding Plaintiff's Interrogatory No. 14 has been resolved. Plaintiff also indicated that it would produce its Bates numbered documents, confidential or otherwise, in this case that have been produced in the Related Cases. With respect to trial transcripts in the Related Cases, the Magistrate Judge will retain jurisdiction to address any sealed portions of those transcripts but will require any un-sealed, i.e.publicly available, portions to be produced. As for deposition transcripts in the Related cases, Plaintiff will notify Defendant of the dates, times, and court reporting service that transcribed the deposition of any of Plaintiff's fact witness(es) that are deposed in the Related Cases. Defendant may then obtain those fact witness deposition transcripts of the Plaintiff's witness(es). As for expert deposition transcripts in the Related Cases, Defendant will first confer with counsel in the Related Cases whose confidential information may be disclosed in order to obtain an agreement pursuant to a protective order, or otherwise, to obtain that information. If an agreement cannot be reached with Defendant's counsel and counsel in the Related Cases, the matter may be presented to this Magistrate Judge for a ruling. As for the time of the 30(b)(1) deposition of Mr. Van Heugten, the parties are to meet and confer to discuss the date and time when such deposition may occur.
