JOINT CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: The parties do not consent to conducting further proceedings before a United States Magistrate Judge. A Markman Hearing will take place on September 22, 2026 at 2:00pm in Courtroom 706 of the Thurgood Marshall United States Courthouse. Because of circumstances and complexities unique to patent law, all expert discovery, including reports, production of underlying documents, and depositions, shall be completed no later than April 23, 2027. The parties shall be ready for trial within two weeks following the Joint Pretrial Order due date. This case is to be tried to a jury. Counsel for the parties have conferred and their present best estimate of the length of the trial is four days. So ordered. The initial pretrial conference scheduled for March 5, 2026 is adjourned sine die. The parties are directed to file a joint status letter, one week after the deadline to conclude expert discovery, that includes (1) whether the parties wish to be referred to the District's mediation program or to a settlement conference before a magistrate judge; (2) proposed dates for summary judgment briefing; and/or (3) proposed trial dates within six months of the filing of the status letter.
