District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The Joint Motion for a Protective Order (#141) is ALLOWED. The Court adopts Energetiqs version of paragraphs 1.6(3) and Defendants version of paragraphs 1.6 (2) and 6.2(a). The Court agrees that the Order shall create the third category of documents suggested by Defendants, however, the Court declines to adopt proposed paragraph 4.3 except for 4.3(g). To the extent the parties have not agreed upon procedures for protecting documents shielded by the varying levels of protections provided for in the Order while in the possession of the respective law firms and related persons, the parties are urged to agree upon such language. The scope of the patent prosecution bar in paragraph 7 is as proposed by Energetiq except (1) the topic listed is subject to amendment to extend the scope beyond the listed topic, by motion filed prior to disclosure of an additional topic and (2) the Court adopts the ethical wall language proposed by Defendants. The parties shall submit a final revised version of the protective order reflecting the Courts rulings by September 4, 2015. To the extent, the parties cannot agree regarding the procedures for protecting the documents in possession of the law firms, they may include in the draft their respective proposals along with a combined statement, not to exceed six pages in total, three pages for either side, and the Court will resolve the dispute.Defendants shall respond to the Emergency Motion to Compel by September 4, 2015. Defendants response shall include an explanation of what it views as LS2, YieldStar 350 and the product under development by some of defendants for YieldStar 350, to the extent, in defendants view, these terms describe different things.
