ORAL ORDER: Having considered the parties' letters related to Plaintiff's motion to strike (D.I. 85-1, 86, 87-1), IT IS HEREBY ORDERED that Plaintiff's motion (D.I. 85) is DENIED. There is a genuine dispute as to whether the claimed "memory controller" must be reconfigurable and it is appropriate that this dispute be resolved during claim construction. Defendant's position on this dispute has not changed; instead, Defendant's modified proposed construction provides further clarity, assisting the Court in understanding the parties' dispute. There is more than adequate time for Plaintiff to be fully and fairly heard on the merits of the claim construction dispute (and Defendant proposed reasonable modifications to the schedule that would also have alleviated any prejudice to Plaintiff).
