ORDER: Given the dispute about certain scheduling deadlines in this patent infringement action, the Court directed the parties to file supplemental letters "delineating their positions on those deadlines and citing the local [patent] rules or case law supporting their positions." DE 28 .Plaintiff subsequently filed a letter requesting that the Court set dates for service of "amended or final contentions" and conceded that the Local Patent Rules in this District do not require any such deadlines. DE 32 at 1. Notably, Plaintiff cited no case law supporting this position. Conversely, Defendant argues that "Plaintiff seeks to add a second set of deadlines not contemplated by the Local Patent Rules," and asserts that Plaintiff's requested deadlines are unnecessary because the parties are required to timely supplement their contentions as needed under Local Patent Rule 9 and Fed. R. Civ. P. 26(e). DE 33 at 2 (citing PopSockets LLC v. Quest USA Corp., No. 17-CV-3653, 2018 WL 2744707, at 3 (E.D.N.Y. June 7, 2018)). The Court has the discretion to modify the deadlines set forth in the Local Patent Rules (see E.D.N.Y. L. Patent R. 1(a)), but the Court sees no reason to deviate from them in this case. See Midwest Athletics & Sports All. LLC v. Xerox Corp., 631 F. Supp. 3d 13, 32 (W.D.N.Y. 2022), aff'd, No. 2023-1077, 2024 WL 2145756 (Fed. Cir. May 14, 2024) ("[P]atent local rules are essentially a series of case management orders.") (citation omitted). "The purpose of... the local patent rules in general... is to 'require parties to crystallize their theories of the case early in the litigation' so as to 'prevent the shifting sands approach to claim construction.'" Infinity Headwear & Apparel, LLC v. Jay Franco & Sons, Inc., No. 15-CV-1259, 2017 WL 3309724, at 3 (S.D.N.Y. Aug. 2, 2017) (quoting Keranos, LLC v. Silicon Storage Tech., Inc., 797 F.3d 1025, 1035 (Fed. Cir. 2015) (internal citation omitted)). Furthermore, "[t]he purpose of infringement contentions is to provide notice of a plaintiff's specific theories of infringement, which in turn streamlines discovery and narrows the issues for trial." Midwest Athletics, 631 F. Supp. 3d at 32 (internal quotation marks and citation omitted).As discussed in Popsockets, Local Patent Rule 9 and Fed. R. Civ. P. 26(e) permit a party to file supplemental contentions in a timely manner and give the opposing party an opportunity to seek to strike those supplemental contentions if necessary. PopSockets, 2018 WL 2744707, at 3 n.5; see also Times Three Clothier, LLC v. Spanx, Inc., No. 13-cv-2157, 2014 WL 1795210, at 4 (S.D.N.Y. May 6, 2014) (granting a motion strike the amended disclosure of certain claims and infringement contentions). As noted above, Plaintiff has not provided the Court with case law that supports imposing deadlines beyond those contemplated by the Local Patent Rules. The Court is not inclined to pre-determine the timeliness of any supplemental contentions, and any concerns about the timeliness of any such contentions may be addressed in a subsequent motion to strike. See PopSockets, 2018 WL 2744707, at *3 n.5.Accordingly, the Court REJECTS Plaintiff's request that the Court approve a schedule with a second set of "final" contentions deadlines. It is hereby ORDERED that the parties meet and confer and submit by 3/20/2026 a joint proposed schedule complying with the Local Patent Rules and this Order. Ordered by Magistrate Judge Lee G.
