ORAL ORDER: At the present time, Judge Fallon has decided to conduct the mediation scheduled for June 17, 2020 telephonically. The logistics of the telephonic mediation shall be as follows: Plaintiffs counsel shall make arrangements for a dial-in number for all counsel, including the Judge, to use throughout the mediation process when the mediation begins. This line should be available throughout the mediation should the Judge wish to have discussions with all parties. Plaintiffs counsel shall also arrange for a separate line for their private discussions with the Judge throughout the mediation process. Defense counsel shall arrange for a separate line for their private discussions with the Judge throughout the mediation process. These lines should remain open for use by counsel and the Court until the mediation is concluded. Plaintiffs counsel shall provide all of the dial-in information by email to Judge Fallon, with a copy to her Courtroom Deputy, Ms. Hicks, by 12:00 Noon Eastern Monday, June 15, 2020. IT IS FURTHER ORDERED that the Court has issued a Standing Order dated 3/13/20 regarding paper documents coming into the Court. This would include mediation statements. Therefore, until further notice, counsel shall be permitted to email mediation statements to Judge Fallon, with a copy to Ms. Hicks on their due date. Since the Judge is permitting the email of the statements, they shall still be due on the date and time (EST) specified in the Mediation Scheduling Order. Counsel are cautioned to limit the number of exhibits to the statements being emailed. Exhibits shall be single-sided only. ORAL ORDER: Having reviewed Ciner's motion regarding discovery disputes (D.I. 63 ) and the associated letter briefing and exhibits (D.I. 65, 66), it is HEREBY ORDERED that Ciner's request is DENIED. The Court agrees with Ciner that the search term in dispute is likely to identify relevant documents; however, the Court is persuaded by Genesis's argument that Ciner's request is not focused and is overbroad. Having reviewed the submitted exhibits, the Court agrees with Ciner that Genesis's proposed alternative to Ciner's term is underinclusive, but it appears to the Court that other, more focused search strings discussed by the parties may be sufficient to identify the information sought. For example, it appears that one or both of the two search strings discussed on the bottom of Exhibit 8 to Ciner's letter (D.I. 65-1, Ex. 8 at 4) would hit on the document set forth as Exhibit 6 (id., Ex. 6). The Court also acknowledges and relies upon Genesis's statement that it "stands ready to respond to reasonable requests for documents." (D.I. 66 at 2.) Thus, for example, if there was reason to believe that other documents of the same type as the document set forth as Exhibit 5 to Ciner's letter (D.I. 65-1, Ex. 5) are relevant to any party's claim or defense, the Court is confident that the parties can negotiate production of such relevant documents.
