ORAL ORDER re 228 - IT IS HEREBY ORDERED that the joint motion for a discovery dispute conference is DENIED without prejudice to renew. So far this year, the parties have filed five discovery dispute motions (and one protective order dispute motion) and had three discovery dispute conferences before the undersigned. Given the numerous discovery disputes raised to date, the Court is not convinced that the parties are engaging in "reasonable efforts" to resolve discovery disputes on their own. This seems especially true given that the parties indicate that they spent a single hour meeting-and-conferring on "various discovery disputes" – a discussion that included two of the three issues raised in the motion with no indication of how long was spent on each topic (and no mention of the third issue at all). The parties may refile their motion if they are unable to reach a resolution after engaging in additional efforts to meet and confer in good faith (i.e., in person or by telephone). ORAL ORDER re 240 & 265 - Having reviewed Element's two Motions for Conference to Resolve Discovery Dispute, IT IS HEREBY ORDERED that an in-person hearing is set for September 18, 2026 at 10:00 AM before Judge Eleanor G. Tennyson in Courtroom 2B. Each side will be limited to twenty (20) minutes of argument. Lead trial counsel (i.e., the persons trying the case) must be present at this hearing, and the parties shall be prepared to meet and confer in person at the hearing prior to the Court taking any action. On or before 11:00 AM on August 28, 2026, Element shall file with the Court a letter not to exceed four (4) pages in no less than 12-point font outlining the issues in dispute and its position on those issues. Element shall attach to its letter a draft order that identifies with specificity the relief sought by that party on an issue-by-issue basis. On or before 11:00 AM on September 4, 2026, Illumina may file a letter not to exceed four (4) pages in no less than 12-point font outlining its opposition.
