ORAL ORDER: The Court, having reviewed Defendants' discovery dispute motion, (D.I. 58 in Civil Action No. 18-1630-MN-CJB and Civil Action No. 18-1631-MN-CJB), and the parties' letter briefs, (D.I. 67, 69), and having heard oral argument, HEREBY ORDERS as follows: With regard to the dispute over Defendants' Document Request 42 (the "RFP") and Plaintiff's production of "documents reflecting the technical and design aspects of its licensees' products[,]" (D.I. 67 at 1), Defendants' request is GRANTED IN-PART. As to the seven licensed products that Plaintiff has suggested potentially read on one or more of the asserted claims, (D.I. 69 at 1), the documents that Defendants seek are at least relevant to the issue of commercial success for the reasons Defendants articulate, (D.I. 67 at 2). And at least as to the production of documents relating to those seven products, the Court does not have a sufficient basis to find that the document production at issue would be disproportionate to the needs of the case or otherwise unduly burdensome, pursuant to Federal Rule of Civil Procedure 26(b). However, with regard to documents responsive to the RFP that relate to any other product that has been licensed under the patent in-suit (the "other products"), and in light of the apparently substantial number of such other products, an order requiring the production of such discovery could well be unduly burdensome. For now, the Court DENIES the remainder of Defendants' request as to such other products WITHOUT PREJUDICE to later renew, if Defendants can make a better record about the relevance of such documents and the extent to which production thereof would not be unduly burdensome. Lastly, to the extent that the discovery ordered above conflicts with Plaintiff's confidentiality obligations to third parties, Plaintiff shall promptly advise the Court of this, so that the Court can set out an appropriate process for resolving such issues. Ordered by Judge Christopher J. Burke on 1/28/2020. Associated Cases: 1:18-cv-01630-MN-CJB, 1:18-cv-01631-MN-CJB(dlb) Modified on 1/28/2020 (dlb). (Entered: 01/28/2020)

ORAL ORDER: The Court, having reviewed Defendants' discovery dispute motion, (D.I. 58 in Civil Action No. 18-1630-MN-CJB and Civil Action No. 18-1631-MN-CJB), and the parties' letter briefs, (D.I. 67, 69), and having heard oral argument, HEREBY ORDERS as follows: With regard to the parties' dispute over Defendants' Interrogatory No. 4, and particularly Defendants' request that Plaintiff provide responsive information listed in the bullet points found at D.I. 67 at 2-3, Defendants' request is GRANTED. The Court agrees with Defendants that discovery about the seven products at issue is relevant for the reasons previously set out above. Furthermore, during the teleconference, Defendants' counsel sufficiently explained why each bullet-point category of requested information was actually needed in this case. As Plaintiff does not argue that it would be unduly burdensome to provide such a response, Defendants' request is appropriate. Ordered by Judge Christopher J. Burke on 1/28/2020. ORAL ORDER: The Court, having reviewed Defendants' Motion to Stay Pending Inter Partes Review ("IPR"), (D.I. 53 ) ("Motion"), and the parties' briefs, (D.I. 54, 57, 65), and having considered the three stay-related factors, HEREBY ORDERS that Defendants' Motion is DENIED WITHOUT PREJUDICE to renew following a decision by the Patent Trial and Appeal Board ("PTAB") as to whether to institute IPR proceedings. Here, the Court will follow its own recent, prior precedent as to stay motions filed prior to a PTAB institution decision. Blue Spike LLC v. Dish Network Corp., Civil Action No. 19-160-LPS-CJB, (D.I. 22); Advanced Microscopy Inc. v. Carl Zeiss Microscopy, LLC, Civil Action No. 15-516-LPS-CJB, 2016 WL 558615, at *1-2 (D. Del. Feb. 11, 2016). As it has articulated in those cases, the Court (absent some unique circumstance not present here) does not see the wisdom in staying a case in favor of the occurrence of an event (grant of an IPR petition and subsequent institution of an IPR) that has not happened and that has a significant chance of never happening. (See D.I. 54, ex. F at 7) The Court also notes that these cases are not exactly in their infancy, as they were filed in October 2018, six months have passed since a Scheduling Order issued and the parties are well into fact discovery. In the future, if one or both of the IPR petitions are granted, and if Defendants then wish to renew their Motion, Defendants should file a one-page letter with the Court indicating their intent to do so. The Court will then set an abbreviated letter briefing schedule on the renewed motion (but will also take into account any relevant content from the briefs already filed as to the instant Motion).Ordered by Judge Christopher J. Burke on 2/10/2020. Associated Cases: 1:18-cv-01630-MN-CJB, 1:18-cv-01631-MN-CJB(mlc) (Entered: 02/10/2020)

ORAL ORDER: The Court, having reviewed Plaintiff's Motion for Leave to File Second Amended Complaint ("Motion") to add a claim of willful infringement, (D.I. 63), and the parties' briefs, (D.I. 64, 68, 70), and having heard oral argument, HEREBY GRANTS-IN-PART Plaintiff's Motion for the reasons that follow. The Court disagrees with Defendants that Rule 16(b)'s good cause requirement applies here. That rule would only apply if the motion was filed after the expiration of the deadline for amending pleadings in the Scheduling Order. (D.I. 68 at 1) However, the current Scheduling Order deadline for amendment is October 18, 2020. (D.I. 23 at para. 3) It seems clear that Defendants did not intend for this to be the relevant deadline, and that this date ended up in paragraph 3 of the Scheduling Order due to Defendants' mistake. (D.I. 68 at 1-2) But it is there, and the Court accepts Plaintiff's counsel's assertion that it believed this date was in fact the applicable deadline (and that Plaintiff relied on that fact). Thus, because the motion comes well before the deadline to amend pleadings, and because Defendants acknowledge that amendment at this time would not cause them prejudice, the Court cannot find that the Motion is the product of "undue" delay pursuant to Rule 15(a) (even if Plaintiff surely could have acted quicker in bringing the Motion). See Cureton v. Nat'l Collegiate Athletic Ass'n, 252 F.3d 267, 273 (3d Cir. 2001). With regard to the issue of futility, the Court acknowledges that the allegations regarding willful infringement in Plaintiff's proposed amended complaint are bare bones. (D.I. 63, ex. 2) And although those allegations establish pre-suit knowledge of the patent in-suit, the sparse pleading leaves the Court a bit unsure about whether Plaintiff can plausibly plead that Defendants thereafter knew or should have known that their conduct amounted to infringement of the patent in-suit. (D.I. 68 at 2-3) The Court suspects that, in the end, Plaintiff probably can successfully plead facts that make this plausible, and (from Plaintiffs counsels remarks during oral argument) it understands that Plaintiff does possess additional facts that it could plead as to this issue. Therefore, for efficiency's sake, the Court ORDERS that: (1) Plaintiff's Motion is GRANTED, to the extent it seeks leave to file an amended complaint alleging willful infringement, but Plaintiff must do so by way of the submission of a further amended complaint that provides additional factual allegations in this regard.; (2) By no later than February 19, 2020, Plaintiff shall file such further amended complaint.; (3) If Defendants believe that the willful infringement claim in that complaint is not plausible, they may thereafter file a motion to dismiss the claim.; and (4) If a motion to dismiss is filed, briefing on it shall be as follows: (a) Defendants shall file an opening letter brief of no more than four (4) single-spaced pages; (b) by no more than one week after Defendants file their opening letter brief, Plaintiff may file an answering letter brief of no more than four (4) single-spaced pages; and (c) by no more than one week after Plaintiff files its answering letter brief, Defendants may file a reply letter brief of no more than two (2) single-spaced pages. Ordered by Judge Christopher J. Burke on 2/12/2020. Associated Cases: 1:18-cv-01630-MN-CJB, 1:18-cv-01631-MN-CJB(dlb) (Entered: 02/12/2020)
