ORDER denying 37 Motion for Pre Motion Conference. Both sides' submissions, but particularly plaintiffs', dwell too heavily on the inferences they want the Court to draw rather than the evidence and law that supports their positions. A conference based on these submissions would not be productive. Instead, within seven days, the ITW defendants are directed to file a statement pursuant to Local Rule 56.1, and plaintiffs are required to file a responsive statement under Local Rule 56.1 within 7 days thereafter. These statements must STRICTLY COMPLY with not only Local Rule 56.1 but this Court's Individual Practice Rules concerning Local Rule 56.1 statements; the failure to do so may result in denial of the ITW defendants' motion or, if plaintiffs do not comply, the deemed admission of matters in the ITW defendants' Local Rule 56.1 statement. The premotion conference is adjourned to 6/22/17 at 10:00 a.m. in Courtroom 8D South. The parties should bring with them the complete record that will be in play on summary judgment, depositions and documents, as the Court intends to have the parties lead it through the weeds to the extent necessary, no matter how long that takes. With regard to plaintiffs' proposed motion to amend, the proposal is so vague, referencing "some additional claims," that the Court does not understand what plaintiffs are talking about. It sounds like all that has happened is that plaintiffs obtained evidence during discovery that they think supports their claims, as one would hope, and they want to amend to reference that evidence and to add duplicative claims for relief that they could have just as easily included in the original complaint, albeit on less evidence. If that's what this turns out to be, the Court is not inclined to allow it, or if it does allow it, it may impose sanctions on plaintiffs for delaying the case. If plaintiffs expect to obtain leave to amend, they are going to have to show that could not have reasonably pleaded these additional claims, whatever they are, much earlier in the case. Within seven days, they are to file their motion for leave to amend, particularly focusing on this issue, and of course including a copy of the proposed amended complaint.
