ORAL ORDER: Having reviewed the parties' briefing and letters and other submissions (see D.I. 17-23, 29, 32, 51, 54, 58, 59, 60, 63, 65, 68), IT IS HEREBY ORDERED that Defendants' motion to stay (D.I. 50) is GRANTED and Defendants' motion to transfer (D.I. 16) is DENIED WITHOUT PREJUDICE to renew after the Section 101 motions in the related matters have been resolved. The Court exercises its discretion in this manner in light of the facts that: (i) Judge Burke granted a stay of the related actions pending disposition of motions to dismiss or for judgment on the pleadings for failure to claim patent eligible subject matter, motions with respect to which Judge Burke heard oral argument in late May, and judicial economy is promoted by resolution (in one District) of fully-briefed and argued patent eligibility issues; (ii) the Section 101 motions are directed to the '974 patent, which is the same and only patent-in-suit here; (iii) while some discovery has taken place, and the claim construction process has begun (but no briefing has yet been filed), substantial additional expenditures (for all parties) can reasonably be deferred until after it is determined whether the patent-in-suit is patent eligible; (iv) there has been no unreasonable delay in Defendants' filings; and (v) any prejudice to Kaavo from the stay the Court is entering (due to delay in enforcement of its patents against a purported competitor, although the Court recognizes the parties dispute whether they compete with one another) is substantially outweighed in the overall balance by the interests favoring a stay. IT IS FURTHER ORDERED that all remaining dates in the scheduling order (D.I. 37) are VACATED and the parties shall provide the Court a joint status report no later than September 10, 2015. ORAL ORDER: The Court has reviewed the parties' joint letter regarding a case schedule for resolution of Section 101 issues as to the remaining dependent claims---a process that was made significantly more difficult due to the inability of the parties to make any real effort at compromise in their letter. ORAL ORDER: Having reviewed the parties' Joint Status Report (D.I. 120) and cognizant of the different standards for motions under Rules 56 and 60, the Court finds it will be most efficient (and helpful to the Court), and not unduly prejudicial to the parties, to have all of the issues relating to Section 101 addressed in a single set of briefs. Accordingly, IT IS HEREBY ORDERED that briefing on any renewed motion(s) concerning Section 101 proceed as follows: (i) Defendants shall submit an opening brief, not to exceed thirty (30) pages, due January 24, 2018; (ii) Kaavo shall file an answering brief, not to exceed thirty (30) pages, due February 14, 2018; and (iii) Defendants shall file a reply brief, not to exceed fifteen (15) pages, due February 26, 2018. Notwithstanding the structure of the briefs, Defendants are free to argue that the standards for reconsideration are not met.
