MINUTE entry before the Honorable Joan B. Gottschall: In the most recent round of briefing on plaintiff's motion for a temporary restraining order, objector eBay, Inc. ("eBay"), argues that it has been prejudiced because plaintiff filed several hundred pages of screenshots showing the allegedly infringing products under seal, but plaintiff did not serve eBay and the other third-party providers with copies of the screenshots and other sealed documents on which it relies in its motion (collectively, "sealed TRO exhibits"). ECF No. 47 at 3 n.1. Plaintiff responds that it is up to the court's discretion whether to permit eBay access to the sealed TRO exhibits. ECF No. 48 at 1-2. Plaintiff is mistaken. Federal Rule of Civil Procedure 65(a) specifies the procedure for moving for an ex parte temporary restraining order. See also LR 5.5(d). Plaintiff utilized the ex parte procedure for defendants but gave notice to the third-party providers and served them with its motion for a TRO. Because the third-party providers had not filed appearances, Fed. R. Civ. P. 5(a) and Local Rule 5.5, as interpreted by the caselaw, required plaintiff to serve the third-party providers with the sealed TRO exhibits, along with all exhibits to its motion and supporting briefing. See, e.g., Glick v. Koenig, 766 F.2d 265, 269-70 (7th Cir. 1985); Almy v. Kickert Sch. Bus Line, Inc., 2013 WL 80367, at *5 (N.D. Ill. Jan. 7, 2013), aff'd, 722 F.3d 1069 (7th Cir. 2013). The local rules of this court contain no exception to the service requirement for documents filed under seal. See LR 26.2, 5.5. Plaintiff is therefore ordered to serve the third-party providers with all exhibits and other papers on which it is relying, including the sealed TRO exhibits, and file a certificate of service on or before 4/18/2023. The third-party providers will then have until and including 4/20/2023 to raise any arguments they wish about the sealed TRO exhibits, and plaintiff may respond by and including 4/25/2023. ("eBay"), because it concerns a substantive matter, namely the interpretation of the sealed temporary restraining order 133 entered June 30, 2023. The parties seek "guidance as to whether (1) the amount of the eBay defendants' frozen assets should collectively equal $1,290.89 (allocated across defendants in amounts equal to the amount of sales each defendant had, as reported in Exhibit A to the April 20 Supplemental Declaration of Larry Taylor, Dkt. 53, 53-1), or (2) whether each eBay defendant should have $1,290.89 frozen (which would amount to $60,671.83 across all eBay Sellers' accounts)." (numbering added). The short answer is option two. The Taylor declaration provided no method for apportioning the $1,290.89 among the eBay defendants. The court knows of nothing else in the record shedding light on how this amount is divided among the eBay defendants. Accordingly, the temporary restraining order requires eBay to freeze $1,290.89 of each eBay defendant's assets to ensure that plaintiff's equitable right to an accounting is adequately protected. Consistent with the order 132 dated June 30, 2023, the court would be open to modifying the temporary restraining order based on evidence apportioning the allegedly infringing sales among the eBay defendants. ("eBay"), represents that it does not oppose plaintiff's motion to extend the temporary restraining order as to eBay defendants, but eBay asserts that "the timing of the asset freeze will likely be dependent on the Court's ruling on a forthcoming motion" to modify the temporary restraining order and reapportion the asset freeze among the eBay defendants. Status Report 1. eBay "intends to file its motion to modify in the next two business days, and anticipates needing two business days following the Court's ruling on this forthcoming motion to implement the asset freeze." Status Report 2. Plaintiff indicates that it will oppose the forthcoming motion and argues that time is critical given that notice of this lawsuit has been posted widely and defendants, including eBay defendants, are likely aware of it. See id. To the extent eBay may not have implemented the asset freeze required by the temporary restraining order entered 6/30/2023, as clarified 141 on 7/10/2023, eBay must implement the freeze instanter and must not await a ruling on its forthcoming motion to modify the temporary restraining order. Gottschall: Plaintiff has filed a "Motion to Reopen the Case and Amend Default Judgment Order" to reflect that defendant nos. 249, 250, 251, 257, and 269 were dismissed voluntarily before the default judgment was entered (see doc. no. 95 ). The court has identified the following additional defendants which were dismissed voluntarily but included in the default judgment order: defendant nos. 7, 36, 37, 42, 45, and 222. See doc. nos. 228, 230 . Defendant nos. 7, 36, 37, 42, 45, 222, 249, 250, 251, 257, and 269 are stricken sua sponte from schedule A to the default judgment 233 . Plaintiff also moves to reopen based on the representation that it has not concluded settlement negotiations with "several defendants." Plaintiff does not specify which defendants, but plaintiff separately filed a motion 235 to enter a consent judgment against defendant no. 268. When the court previously entered the default judgment requested by plaintiff 233, it closed this case, relying on plaintiff's representation in its motion for entry of default judgment (see doc. no. [212-1] at 1) that it was requesting entry of a "final judgment," which means a judgment disposing of all claims and all parties. See Fed. R. Civ. P. 54(a), 58. Future motions must state clearly when a judgment as to fewer than all claims or parties is requested. If plaintiff has not resolved its claims against all defendants, the default judgment must be set aside in its entirety unless the court finds under Fed. R. Civ. P. 54(b) that there is no just reason for delaying entry of a partial judgment. See Arwa Chiropractic, P.C. v. Med-Care Diabetic & Med. Supplies, Inc., 961 F.3d 942, 950 (7th Cir. 2020). For the same reason, the court cannot enter a partial judgment against defendant no. 268 (as to which plaintiff has requested entry of a consent judgment) without making the findings required by Rule 54(b). Because no Rule 54(b) finding has been requested, plaintiff's motion 235 for entry of a consent judgment against defendant no. 268 is denied without prejudice. Further, because setting aside the default judgment in its entirety (which plaintiff suggests it wants in order to continue settlement negotiations) would be likely to disrupt any ongoing efforts to collect it, the court declines to vacate the default judgment on its own motion. Plaintiff may file an amended motion to reopen or a motion for a Rule 54(b) finding, making clear what relief it is requesting and what Federal Rules of Civil Procedure support that relief. For the reasons stated above, the court strikes the above-listed defendants from the default judgment. The motion for a consent judgment against defendant no. 268 is denied without prejudice. The motion to reopen the case is denied without prejudice since plaintiff has not made clear whether it wishes to set aside the default judgment in its entirety or wishes to move for a Rule 54(b) finding. MINUTE entry before the Honorable Joan B. Gottschall: In its status report 243 filed 2/8/2024, plaintiff represents that eBay, Inc. ("eBay"), "has fully complied with the Default Judgment Order." Based on this representation, plaintiff's motion to compel 238 eBay to comply with the default judgment order is denied as moot. Plaintiff also represents 243 that third-party provider LianLian Global ("LianLian") has not complied with the default judgment order. Although plaintiff served several third-party providers, including eBay, before the judgment was entered, the pre-judgment certificates of service (doc. nos. 12, 14 ) do not state that LianLian was served. Nor was LianLian named in the temporary restraining orders (doc. nos. 65, 133 ) or in the amended preliminary injunction order 100 . The first reference to LianLian appears in paragraph six of the default judgment 233, which was entered in the form proposed by plaintiff's counsel. The court does not routinely compare the third-party providers listed in a proposed default judgment with the providers listed in prior orders. The court relies on counsel to indicate clearly in briefing when any significant changes are made. The briefing on plaintiff's motion 212 to enter default judgment did not indicate that LianLian had been added to the list of third-party providers. On the present record, the court cannot enforce the default judgment against LianLian because "[a] district court must have personal jurisdiction over a party before it can enjoin its actions." Ins. Corp. of Ireland, Ltd. v. Compagnie des Bauxites de Guinee, 456 U.S. 694, 711 n.1 (1982) (citing Zenith Radio Corp. v. Hazeltine Research, Inc., 395 U.S. 100, 111-12 (1963)); accord. Nat'l Spiritual Assembly of Baha'is of U.S. Under Hereditary Guardianship, Inc. v. Nat'l Spiritual Assembly of Baha'is of U.S., Inc., 628 F.3d 837, 853 (7th Cir. 2010). The court has located no evidence that LianLian was given notice of any filing in this case prior to entry of the default judgment order 233 commanding it in paragraph 6 to "permanently restrain and enjoin any accounts connected to Defaulting Defendants or the Defendant Internet Stores from transferring or disposing of any funds." Plaintiff's motion 238 to enforce the default judgment order against LianLian is therefore denied without prejudice for want of personal jurisdiction over LianLian. If it can show that this court had personal jurisdiction over LianLian when it issued the default judgment order, plaintiff may refile its motion within fourteen days, on or before 2/27/2024.
