TEXT ORDER: The Court has reviewed Plaintiff's motion for venue discovery and an extension to its time to respond to Defendants' motion to dismiss at Dkt. No. 20 ("the Motion"). The Motion is DENIED IN PART and GRANTED IN PART. First, as to Plaintiff's request for venue discovery, courts in this District have found that a plaintiff is not entitled to venue discovery prior to the Court's decision on the defendant's respective motion to transfer. See Loyal-T Sys. LLC v. Am. Express Co., No. CV 23-cv-2625, 2024 WL 4381835, at 9, 9 n.6 (D.N.J. Oct. 3, 2024). "That is, a court should not just permit venue discovery as a matter of course; before allowing the discovery to proceed, the court must be satisfied that there is some indication that venue in the forum is appropriate as to the defendant." Id. (citing Galderma Laboratiores, L.P. v. Medinter US, LLC, No. 18-cv-1892, 2019 WL 13114421, at 3 (D. Del. Oct. 25, 2019)). This is to prevent a plaintiff from engaging in "a fishing expedition based only upon bare allegations, under the guise of [venue] discovery." Id. (quoting Galderma, 2019 WL 13114421, at 3). Thus, in order words, a plaintiff's right to conduct venue discovery may only be granted "[i]f a plaintiff presents factual allegations that suggest with reasonable particularity the possible existence of the requisite contacts between [the party] and the forum state...." Toys "R" Us, Inc. v. Step Two, S.A., 318 F.3d 446, 456 (3d Cir. 2003) (citation altered) (Mellon Bank (East) PSFS, Nat'l Ass'n v. Farino, 960 F.2d 1217, 1223 (3d Cir. 1992)). As such, the Court declines to grant venue discovery until the Court issues its decision on Defendants' pending motion to transfer (Dkt. No. 16). Plaintiff's motion for venue discovery is DENIED WITHOUT PREJUDICE. The Court notes that Plaintiff's arguments for venue discovery may be more properly raised within its opposition to Defendants' motion to dismiss and/or transfer; therefore, Plaintiff's request for an extension to submit its opposition to Defendants' motion to transfer is GRANTED IN PART.
