ORAL ORDER: The Court, having reviewed Defendants request for an early Markman/summary judgment motion in connection with the claim term storage device, (D.I. 20), hereby ORDERS that the request be DENIED. There is merit to the request, as the claim term at issue appears in all possible asserted claims, and Defendants cogently set out the rationale for their construction and why it could, if adopted, lead to early resolution of the matter. But because the currently-scheduled Markman hearing is scheduled so close in time, and because the Court is uncertain as to whether any needed discovery on a summary judgment motion could be completed in advance of an early hearing, the better course is to go forward with the currently-scheduled Markman process. If, after receiving the District Courts construction, Defendants think an early summary judgment motion on the storage device term would promote efficiency (and the Court could see how it might), the Courts ruling is without prejudice to their ability to make that case to the District Court. ORAL ORDER In Civil Action No. 18-377-LPS-CJB, the Court today granted-in-part Defendant Spotify USA, Inc.'s ("Spotify") motion to stay and determined to set a case schedule that includes a Markman hearing on July 22, 2019, a fact discovery deadline of October 11, 2019, a hearing on case dispositive and Daubert motions on July 28, 2020, a pre-trial conference on September 11, 2020 and a trial beginning on September 21, 2020.
