ORAL ORDER - IT IS HEREBY ORDERED that, within thirty (30) days from the date of this Order, the parties shall confer regarding proposed dates in the scheduling order and shall submit a proposed order, which is also consistent with the following guidance. The parties shall provide final contentions (i.e., final infringement and invalidity contentions, as well as final non-infringement and validity contentions) around the time that fact discovery closes (i.e., several weeks prior to or after the deadline to complete fact discovery) and at least three weeks before Plaintiff serves its opening claim construction brief. Final contentions shall include a party's contentions under its proposed construction(s), as well as under the opposing construction(s) (if such an alternative contention exists). As such, the parties are encouraged to exchange proposed claim terms and proposed constructions early in the case but in no event later than necessary to allow the parties to include alternative contentions in their final contentions. The joint claim construction chart shall be due one week after the parties have completed their exchange of final contentions, and the joint claim construction brief must be filed at least three weeks before the claim construction hearing. The parties shall leave at least three weeks between the claim construction hearing and the opening of expert discovery. The parties are to use the Court's form scheduling order, which is posted at http://www.ded.uscourts.gov (see Chambers, Judge Noreika, Forms), and the parties must include a proposal for the length and timing of trial. If there are disputes or issues that the Court needs to address in the proposed scheduling order, the parties shall direct the Court to the paragraph numbers in which those appear in a cover letter to the Court. ORAL ORDER: Having reviewed the Motion to Resolve Discovery Order Disputes (D.I. 58) and briefing related thereto (D.I. 62, 65), IT IS HEREBY ORDERED that Network-1's motion to compel the depositions of Ubiquiti's apex witnesses Robert Pera and Ron Sege is DENIED. "Normally, courts will not allow an apex deposition if the high-ranking official does not have first-hand knowledge of relevant information" Brit. Telecomms. PLC v. IAC/Interactivecorp, 2020 WL 1043974, at *8 (D. Del. Mar. 4, 2020) (granting motion to quash deposition of executive because the court "was not convinced" that the executive had unique or personal knowledge of two articles). For Mr. Pera, Network-1 argues that it is possible that Mr. Pera might have pre-suit knowledge of Network-1's patent because he received an unsolicited third-party sales email in 2011 selling an unrelated patent that referenced litigation over Network-1's patent, but it is not clear that the referenced patent is the same as the one in this case. Similarly, for Mr. Sege, Network-1 argues that it is possible that he too might have had knowledge of the Network-1 patent given his position at prior companies, but Network-1 also failed to even attempt to conduct discovery of the prior companies where Mr. Sege might have learned such information. And, I am mindful that the Apex deposition doctrine counsels that less burdensome means of obtaining the information, like interrogatories, should be pursued before seeking the deposition of an apex individual. In re Jevic Holding Corp. 526 B.R. 547, 556 (D. Del. 2017). Here, akin to interrogatories, both Mr. Pera and Mr. Sege submitted sworn statements disclaiming any knowledge of the Network-1 patent before Network-1 filed suit. Network-1's minimal showing of the remote possibility of first-hand knowledge is likely insufficient to warrant a deposition under the apex deposition doctrine but, in any event, in this case such minimal showing is effectively rebutted by Mr. Pera and Mr. Sege's sworn declarations disclaiming knowledge. I am mindful that such declarations may not always be sufficient to avoid a deposition but, here, in light of the thin evidence put forward to even suggest that these individuals might have first-hand information, they are.
