ORAL ORDER: The Court adopts the revised pretrial order (D.I. 306 ) and notes the disputes in 6 & 34. On the first, the Court would like to hear the testimony relevant to the equitable defenses but irrelevant to the jury issues during the trial but outside the presence of the jury. I do not know how much of this there is. Comcast should make a proffer of no more than three pages by the COB September 17 as to the general nature of the testimony, which witnesses will present it, and how much time is needed. Both sides should be prepared to discuss the issue no later than the morning of the first day of trial. On the second, there is no response from Comcast that I can see in the pretrial order, and Comcast should submit a letter explaining its position on the issue by the COB September 17. So, at best, its inconvenient for NexStep to get them from Dr. Stepanians home to Delaware, and, since they are not on Comcasts exhibit list, there is no reason to inconvenience NexStep in that regard, and I see no prejudice to Comcast.
