ORAL ORDER: Having reviewed Defendant Stryker's Motion to Stay (D.I. 94) and the associated briefing (D.I. 91, 107, 113), IT IS HEREBY ORDERED that Stryker's motion is DENIED. A stay would not necessarily simplify the issues for trial, as the Court may permit Orthophoenix to amend its Complaint in lieu of dismissing it should the Court ultimately find that Orthophoenix lacks prudential standing. A stay would unduly prejudice Orthophoenix because, at the time Stryker filed its motion, the parties had already invested significant time over several months, including two Rule 16 conferences, in finalizing the Scheduling Order (D.I. 111). ORAL ORDER: Having reviewed the parties' letters regarding proposed redactions to memorandum opinion D.I. 299, IT IS HEREBY ORDERED that the opinion be unsealed without redactions. The Court is not persuaded that redactions are warranted. The public has a "common law right of access to judicial proceedings and records," Littlejohn v. BIC Corp., 851 F.2d 673, 677 (3d Cir. 1988), including a common law right to inspect, see Leucadia, Inc. v. Applied Extrusion Techs., Inc., 998 F.2d 157, 161 (3d Cir. 1993). Thus, a party seeking non-disclosure bears the burden of showing that "disclosure will work a clearly defined and serious injury," In re Cendant Corp., 260 F.3d 183, 194 (3d Cir. 2001), which "must be shown with specificity," Pansy v. Borough of Stroudsburg, 23 F.3d 772, 786 (3d Cir. 1994). Here, Orthophoenix's sole contention for why redactions are necessary is that the parties' settlement agreement includes a confidentiality provision. Absent any clearly-articulated reasoning about the harm that will come from disclosure, the parties' private settlement agreement does not outweigh the public's interest.
