ORDER denying 253 Motion for Sanctions; denying 253 Motion to Continue. For the reasons stated on the record, the Court GRANTS in part and DENIES in part Teva's motion as follows: 1. Teva's request for a short continuance of the trial date is DENIED. Trial will begin as currently scheduled on June 15,2011, at 11:00 a.m. However, trial as to the inequitable conduct counterclaim will not commence any sooner than June 27, 2011, at 11:00 a.m.. 2. Teva's request to take certain depositions out of time is GRANTED as follows. Teva is granted leave to resume the deposition of Mr. MacFarlane and to take the deposition of Mr. Richardson. Teva is denied leave to resume or take any otherdepositions. The MacFarlane and Richardson depositions shall be completed no later than June 14, 2011. Teva shall take these two depositions at its own expense. Pfizer shall make all good faith efforts to facilitate the taking of these two depositions within the time frame ordered by the Court. If any disagreements regarding the scheduling of these depositions arise, they must be brought to the attention of the undersigned United States magistrate judge as soon as possible. 3. Teva's request to preclude Pfizer from raising the defense of "advice of counsel" as a discovery sanction is DENIED. Teva may raise the question of whether Pfizer has raised or should be permitted to raise the defense of "advice of counsel" by filing a motion in limine which shall be decided by the trial judge. 4. Teva's request to preclude Pfizer from introducing certain documents at trial is DENIED. 5. Teva's request to allow its expert Mr. Weiffenbach to supplement his expert report is DENIED at this time. Teva may renew this motion if so advised after the taking of thetwo depositions mentioned in this Order. 6. For the reasons expressed on the record, the Court declines to sanction Pfizer and declines to award any attorneys' fees or costs associated with opposing Teva's motion. Signed by Magistrate Judge F.
