ORAL ORDER: Having reviewed the parties' letters relating to Plaintiff's request for leave to file an amended complaint, to add three additional patents (to the 14 patents already in-suit) and new Defendant Costco Wholesale (D.I. 74, 75, 79, 80, 81; see also D.I. 82 (status report), IT IS HEREBY ORDERED that Plaintiff may file an amended complaint, in substantially the form attached to its papers, no later than October 14, 2014. (Counsel is advised for future reference that the Court's new procedures require the filing of a separate motion for leave to amend, accompanied by the short letter brief.) Defendants do not oppose the addition of Costco as a defendant, and it is appropriate for Plaintiff to add Costco, as it is allegedly a large seller of Defendants' accused products. It is appropriate to add the additional patents as they are related to the patents-in-suit, Plaintiff's request is timely under the governing scheduling order (which provides until March 2015 to amend the pleadings), and it would be inefficient to require Plaintiff to initiate a new lawsuit asserting the additional patents. The scheduling order (D.I. 67 at 13) contains a schedule by which the patent claims and prior art will become more focused, and at this point no party has asked for that schedule to be modified. With respect to the issues raised in the parties' status report (D.I. 82), if the parties believe they have ripe discovery disputes requiring judicial resolution they should follow the Discovery Matters procedures. IT IS FURTHER ORDERED that Bosch is given leave to produce, no later than July 2, 2015, any evidence - including evidence held by its parent, Bosch GmbH - that sales in the United States of imported vehicles with OE side-lock wiper systems practicing the '607 or '096 patents were not authorized by either Bosch or Bosch GmbH. ORAL ORDER by Judge Leonard P. Stark: Having reviewed the parties' recent letters (D.I. 205, 206), IT IS HEREBY ORDERED that Defendants' request to modify the scheduling order is GRANTED. Given the scope and status of this case, including the large number of patents, the late entry of Defendant Costco, and the numerous issues pending before the Court (and on which the parties' prior approach necessitated the Court to order substantial additional post-hearing briefing), it is no longer reasonable to adhere to the schedule previously entered. The parties shall, no later than July 17, 2015, submit a proposed revised scheduling order to incorporate the following dates: jury trial to begin on February 13, 2017 (the Court is unavailable in March 2017), pretrial conference on January 27, 2017 at 9 a.m., and proposed pretrial order due on January 17, 2017.
