Enter ORDER: This Court grants Scholle Corporations oral motion for clarification regarding the scope of the evidentiary hearing on Rapak LLCs redesigned product set for 10:00 a.m. on October 28, 2014. Scholle claims that the dispute identified by this Court on page nine of its Memorandum Opinion and Order entered July 24, 2014, whether the retaining ring in Rapaks redesign extends above the top surface of the body, is not the issue this Court must consider at the evidentiary hearing. Instead, Scholle claims that the issue that this Court must decide is whether Rapaks redesigned product falls within the scope of the preliminary injunction, and Scholle refers this Court to other areas of its July 24th Opinion and Order that uses the correct language from the claim. Although Scholle did not specify where in the July 24th Opinion and Order it believes this Court used the correct language, the relevant claim language, a retaining ring positioned entirely within the confines of the inner surface and below the top surface of the body, appears on page seven of the July 24th Opinion and Order. This Court agrees that the ultimate issue that this Court must decide at the evidentiary hearing is whether Rapaks redesigned product falls within the scope of the preliminary injunction. To do that, this Court must determine whether Rapaks redesigned product is more than colorably different from the enjoined product. Rapak claims that its redesigned product is more than colorably different from the enjoined product because it does not meet a key limitation present in the only independent claim of the 799 patenta retaining ring positioned entirely within the confines of the inner surface and below the top surface of the body. (Dkt. No. 94 at 4.) The basis for Rapaks claim is a redesigned product in which Rapak increased the height of the retaining ring so that it purportedly extends above the top surface of the body. Consequently, as a starting point for its analysis, this Court must determine whether Rapaks redesigned product actually has a retaining ring that extends above the top surface of the body. Though not the ultimate issue that this Court must decide, it is an issue nonetheless. In its order granting Scholles motion for a preliminary injunction, this Court explained that [a]lthough Rapaks retaining ring extends above the bottom edge of the sloping surface, it does not extend above the top edge, which is where the top surface is. Therefore, the accused product likely satisfies this limitation. (Dkt. No. 65 at 7.) This finding was consistent with an argument Scholle made against the enjoined product. According to Scholles counsel, that retaining ring is totally within the confines of that inner surface, and its below the top surface. Again, thats where the parties dispute [is]... You have the top surface over there, and theres your retaining ring. Okay? Underneath it. And that retaining ring is clearly below the top surface. (Pre. Inj. Hrg Tr. 84:19-85:15 (Jan. 9, 2014).) Of course, the issue of whether the retaining ring in Rapaks redesign extends above the top surface of the body is an issue for this Court to decide, considering that Scholle previously relied on the height of the retaining ring in the enjoined product to show a likelihood of infringement and Rapak claims that it is a key limitation of the claim.Therefore, this Court clarifies its previous order to the extent that it suggests that whether the retaining ring in Rapaks redesign extends above the top surface of the body is the only issue this Court must decide at the evidentiary hearing. This is a threshold determination that this Court must make en route to the ultimate issuewhether Rapaks redesigned product falls within the scope of the preliminary injunction. This Court understands that this determination introduces a number of issues, to include whether the increased height of the retaining ring in Rapaks redesigned product, provided it causes the retaining ring to be above the top surface of the body, makes it colorably different from the enjoined product. Although this Court does not anticipate any further claim construction issues given its discussion of the confines limitation in an earlier order (Dkt. No. 65 at 7) and the parties treatment of this limitation as one that compares the top edge of the retaining ring to the top surface of the body (see, e.g., Pre. Inj. Hrg Tr. 67:4-68:5), this Court will address any claim construction issues necessary to resolve the ultimate issue. Signed by the Honorable Virginia M.
