ORDER denying 180 the Motion for Leave to File Summary Judgment Motion. The Court intends to order that (i) all pleadings and submissions and exhibits in this case that were filed with or cited to the Court in support of, or in opposition to, Plaintiffs and Defendants Motions for Summary Judgment, and (ii) any documents filed with the Court after entry of the October 26, 2012, Order, be unsealed unless any party can, on or before April 14, 2014, show that there is good cause why one or more of these documents or submissions are required, in whole or in part, to be maintained under seal. The Court has reviewed the Pretrial Order 166 submitted by the parties and, in anticipation of the further pretrial instructions to be given to the parties, the Court, in response to specific provisions in the Pretrial Order, amends the parties' pretrial obligations. (See order for filing deadlines and obligations.) The issue to be tried is the nature and scope of Plaintiff's alleged damages as a result of the Court's October 26, 2012, Order holding that that SIPCO breached the L&G Settlement. ORDER IT IS HEREBY ORDERED that Siemens's Objections to SIPCO's Deposition Designations 196 are OVERRULED IN PART and DEFERRED IN PART. Siemens's general objection to introduction of the Scartz Deposition as in violation of the Texas Protective Order is overruled. SIPCO shall identify which of Scatz's deposition testimony offered at trial is Confidential Material and the Court will rule then on whether the testimony may be introduced. Siemens shall assert its objections to deposition testimonies of Scatz, Shamash and Liebeler when offered at trial by SIPCO. IT IS FURTHER ORDERED that Siemens's Objections to SIPCO's Trial Witness List 197 are OVERRULED IN PART and DEFERRED IN PART. Moller will not be permitted to testify at trial, pursuant to Rule 37(c) of the Federal Rules of Civil Procedure. Siemens shall assert its objections to Petite's testimony when offered at trial.
