ORAL ORDER: The Court, having reviewed the parties' letter briefs relating to Non-Party Hulu, LLC's ("Hulu") Motion for Protective Order, (D.I. 58 in Civil Action No. 19-145-CFC-CJB), hereby ORDERS that by no later than September 13, 2019, Hulu shall submit a reply letter of no more than 2 single-spaced pages that specifically addresses the Delaware Defendants' argument that Hulu's financial information is directly relevant to these cases: (1) "in order to ascertain the basis for Plaintiff's damages theory, determine whether Plaintiff and its experts are taking inconsistent positions across litigations, and cross-examine or impeach Plaintiff's experts on such inconsistencies" and (2) to assess whether any settlement or jury award in the California Litigation is comparable for the damages analysis in these cases.
