ORDER - This case is before the Court on defendant's "Motion for Leave to Amend Its Answer and to Add Additional Counterclaims," #41, to which plaintiffs have filed a "Memorandum in Opposition," #46, and defendant, in turn, a "Reply," # 49. This Court agrees with defendant that this case was only recently filed, no discovery has taken place, and no case management order has been filed under Rule 16, and as such, plaintiffs will not be unduly prejudiced. ORDER - Finally, this Court finds that an award of attorney's fees and costs in the amount of $15,000 (which is only half of the $30,000 claimed by plaintiff) is fair and reasonable. This amount is not punitive in nature and simply reimburses plaintiffs in part for the expense of prosecuting the motion to disqualify.
