ORAL ORDER - Having reviewed the parties letters and other materials submitted in connection with various discovery disputes (see D.I. 100, 101, 104, 105), IT IS HEREBY ORDERED that: (i) DRLs request for an order compelling Galderma to produce deposition transcripts relating to the Amin patents is DENIED, as the Court is not persuaded that any relevance of these materials (which appears to be minimal) makes them proportionate to the needs of the case, particularly given the potential burden involved in handling issues relating to the protective order in the earlier case; (ii) Galdermas request that DRL be ordered to supplement its responses to interrogatories 1 and 2, with DRLs noninfringement contentions, is DENIED, as Galderma has failed to persuade the Court that DRL can meaningfully supplement in light of the status of Galdermas infringement contentions; (iii) Galdermas request to compel responses to interrogatories 11-15 is GRANTED, as the information sought is relevant to secondary considerations of nonobviousness (e.g., commercial success) and is proportional to the needs of the case; and (iv) Galdermas request for a protective order and to quash testimony subpoenas for three witnesses is DENIED, as the discovery sought by DRL is plainly relevant, DRL has had no opportunity to date to examine these witnesses, and Galderma has failed to show that permitting DRL to exercise its right to depose witnesses with relevant evidence would be improper or unduly burdensome.
