ORAL ORDER: Having reviewed the parties' submissions (see, e.g., D.I. 103, D.I. 104) in response to the Court's March 6, 2023 Oral Order (D.I. 102), IT IS HEREBY ORDERED that the discovery teleconference scheduled for Thursday, March 9, 2023 at 4:00 p.m. is cancelled. ORAL ORDER: Having reviewed Torchlight's request for the Court's guidance regarding purported work-product material contained in some of the documents Torchlight was ordered to produce (D.I. 107) and Torchlight's March 17th Letter addressing the same issue (D.I. 111), IT IS HEREBY ORDERED that Torchlight's request to redact such material as proposed in the attached Exhibit 2 to D.I. 111 and as listed in the privilege log attached as Exhibit 2 to D.I. 111 is GRANTED. Torchlight has not waived the ability to assert the work product doctrine, and Defendants have failed to articulate a "substantial need" for the redacted information or how they would suffer "undue hardship" in obtaining the substantial equivalent of the redacted information by other means.
