Defendants oppose the request, arguing that the proposed amendment is futile 31 . Having reviewed the proposed amendment and the briefs ( 31, 32 ) submitted, the Court finds that the proposed amended complaint contains well-pleaded factual allegations as to whether the claim elements or their ordered combination are well-understood, routine and conventional. Taking those allegations as true (as Aatrix requires at this stage and under these facts), Plaintiff's proposed amended complaint adequately alleges that the claims contain a sufficient inventive concept and, therefore, amendment would not be futile (nor would the amended complaint properly be the subject of a motion to dismiss). Thus, Plaintiff's motion for leave to amend is GRANTED and Defendants may raise any continued 101 challenge at summary judgment to the extent there are no factual issues that preclude resolution at that stage.
