TEXT ORDER: As discussed in the Markman hearing held on May 20, 2026, the parties shall submit written answers to the following questions by 5.p.m. on May 29, 2026. Plaintiff shall (1) identify the functional differences between a "bone positioning device" and a "bone positioning guide." Plaintiff shall provide specific examples of these differences, as well as an example of a "bone positioning device" that is not a "bone positioning guide." Please detail how the language of the patent supports any distinct functions between a "bone positioning guide" and a "bone positioning device." Plaintiff shall also (2) explain how, if at all, this case is distinguishable from Edwards Lifesciences LLC v. Cook Inc., 582 F.3d 1322 (Fed. Cir. 2009) with respect to whether the cannon of claim differentiation trumps the patent specifications concerning "guide surface" in both the '387 and '849 patents. Defendants shall (1) explain how they meet their burden of proving the alignment terms are indefinite and fail to inform with reasonable certainty those skilled in the art about the claims' scope, and (2) relatedly, clarify what authority supports their proposition that the alignment terms require mathematical precision to be definite. Both parties shall (1) explain the weight the Court should give to dictionary definitions when determining the ordinary meaning of claim terms.
