After hearing argument the court embraces defendant Square's concept of phase discovery. The court directs the parties to meet and confer to determine what discovery is necessary for Phase I discovery (i.e., what basic discovery is necessary to prepare for the Markman Hearing and the initial settlement conference). The court will require the parties to submit an amended discovery plan and scheduling order; however, before such an order is finalized, the parties shall submit a Joint Memorandum identifying the areas of dispute with regard to Phase I. The Joint Memorandum shall be filed no later than Friday, March 7, 2014.
