Text Order GRANTING 12 Motion to Lift Stay entered by Judge Alan D Albright. Before the Court is Plaintiff VideoLabs's Motion to Lift Stay. This case was previously stayed pending an ITC investigation, which has since concluded and which Plaintiff represents it will not appeal. Plaintiff moves to lift the stay in its entirety; Defendant HP requests that the stay be modified to permit only an early dispositive motion on invalidity. The Court agrees with VideoLabs that the stay should be entirely lifted. ITC patent decisions are not binding on this Court. See Tex. Instruments, Inc. v. Cypress Semiconductor Corp., 90 F.3d 1558, 1569 (Fed. Cir. 1996). Plaintiff will be prejudiced by delay if infringement and damages issues are stayed but the Court ultimately disagrees with the ITC. For similar reasons, the potential for simplification of issues is lessened. In addition, a complete lifting of the stay does not preclude early litigation of dispositive invalidity issues, so there is at best minimal prejudice to Defendant.
