The Court will construe the terms asked to be construed at the Markman hearing. With respect to the claims cited as indefinite by Defendants,1 it would be premature for the Court to decide, at the Markman hearing, by clear and convincing evidence as a matter of law that the claims are indefinite. Neither Defendant nor Plaintiff has offered a proposed construction for these terms.
