ORAL ORDER: Upon consideration of the parties' respective letter briefs regarding the protective order disputes (Civil Action No. 25-872, D.I. 71 and D.I. 72; and Civil Action No. 25-873, D.I. 70 and D.I. 73), IT IS HEREBY ORDERED that the Court adopts Defendants' proposed paragraph 7.2(b) which excludes Voxer's CEO Irv Remedios from access to confidential information. Plaintiffs have failed to demonstrate how Mr. Remedios' access to the confidential information is necessary or required, particularly where both in-house and outside counsel are permitted access to the information. Moreover, Defendants raise a legitimate concern that Mr. Remedios, as a competitive decisionmaker, could misuse or disclose confidential information. Under the circumstances, such risk outweighs any speculative prejudice that Plaintiffs assert.
