As an initial matter, I agree with Defendants that this dispute is premature, as Plaintiff's request is contingent on the PTAB granting Plaintiff's pending motion in that tribunal. Plaintiff's request is also denied on the merits, as Plaintiff's requested "declaration" is contrary to the plain language of the Protective Order entered by this Court, which Plaintiff agreed to.
