ORAL ORDER: The Court, having reviewed Plaintiff's pending discovery dispute motion ("Motion") in these related cases, (D.I. 46 in Civil Action No. 21-1117-MN-CJB; D.I. 62 in Civil Action No. 21-1119-MN-CJB; D.I. 45 in Civil Action No. 21-1120-MN-CJB), along with the accompanying letter briefs, provides the following guidance to the parties in advance of the June 27, 2022 teleconference (citations below will be to the docket in Civil Action No. 21-1119-MN-CJB): (1) In its letter requesting this discovery dispute teleconference, Plaintiff identified Interrogatory ("ROG") Nos. 1, 2, 3 and 6 and Requests for Production ("RFP") Nos. 3, 4, 5, 22 and 35 as being in dispute. (D.I. 60 at 1) Because Defendant asserted that there had been no prior meet and confer about these discovery requests, the Court ordered that one occur prior to the submission of discovery dispute letter briefs. (D.I. 61) Despite this, during the meet and confer, Plaintiff did not raise any concerns regarding any of the listed RFPs. (D.I. 65 at 2; id., ex. 2 at 1, 8-10) Because Plaintiff did not include these RFPs in the required meet and confer discussion, the Court will not hear argument regarding any of those RFPs on Monday's call and DENIES the Motion without prejudice as to those RFPs.; (2) The Court also DENIES the Motion without prejudice as to ROGs No. 1 and 6, as Plaintiff did not specifically address those ROGs in its letter brief in any substantive way. There are, however, two ROGs that Plaintiff raised in its discovery dispute request letter, (D.I. 60 at 1), in the required meet and confer process, (D.I. 65, ex. 2 at 8-10), and in its letter brief, (D.I. 63 at 2): ROGs No. 2 and 3. The Court will address the dispute as to those ROGs on Monday.; (3) By no later than 5:00 pm EST on June 24, 2022, Plaintiff shall file a supplemental letter brief, of no more than two single-spaced pages, that answers the following questions: (a) As to ROGs No. 2 and 3, Plaintiff complains that Defendant's responses have been deficient because they "made it difficult to understand whether Netgear has possession, custody and control of [information requested pursuant to ROG 3]" and have failed to "identify third-parties and chipsets in response to written discovery request[s.]" (D.I. 63 at 2-3) But Defendant now points to its supplemental responses to ROGs No. 2 and 3, in which it identifies various relevant third-party chipmakers, service providers and ODMs, as well as information about the third-party products that those entities produce. (D.I. 65 at 2-3; id., ex. 3 at 8-24) In light of Defendant's supplemental response, in what way does Plaintiff currently know Defendant's response to ROGs No. 2 and 3 to be deficient?; and (b) To the extent that Plaintiff's allegations about Defendant's allegedly deficient core technical document production are said to be relevant to the dispute over ROGs No. 2 and 3, how, specifically, does Plaintiff currently know Defendant's core technical document production to be deficient?; (4) By no later than 5:00 pm EST on June 24, 2022, Defendant shall file a supplemental letter brief, of no more than two single-spaced pages, that answers the following question: Defendant asserts that it "would have to designate many witnesses" in order to answer the full scope of the four new Rule 30(b)(6) deposition topics at issue, which would be "inefficient and overly burdensome[.]" (D.I. 65 at 4) What more information can Defendant provide to the Court to help it understand how many witnesses would be required, or how a complete response would in fact be unduly burdensome to Defendant?; and (5) The Court agrees with Defendant that there is not a sufficient record for it to order discovery as to non-specifically-accused products, (see D.I. 65 at 3 n.4), and so the Court will not do so; instead it will focus on the products currently accused. Ordered by Judge Christopher J. Burke on 6/23/2022. Associated Cases: 1:21-cv-01117-MN-CJB, 1:21-cv-01119-MN-CJB, 1:21-cv-01120-MN-CJB(dlb) (Entered: 06/23/2022)

ORAL ORDER: IT IS HEREBY ORDERED that at the July 8, 2022 "101 Day" motions hearing, beginning at 9:30 a.m. in Courtroom 2A: (1) the motion in Civil Action No. 21-1119-MN-CJB will be argued first, and each side will have 20 minutes for argument; (2) the motion in Civil Action No. 21-1591-CJB will be argued second, and each side will have 20 minutes for argument; (2) the motion in Civil Action No. 21-1592-CJB will be argued third, and each side will have 20 minutes for argument; and (4) the motion in Civil Action No. 21-1695-MN-CJB will be argued fourth and each side will have 20 minutes for argument. After all of these arguments have concluded, the Court will adjourn and will return at 4:00 p.m. to provide rulings on the motions. Counsel are reminded that each party must be represented throughout the entirety of the hearing (9:30 a.m. to approximately 5:00 p.m., or whenever the hearing concludes) as additional questions may be asked of any party at times other than during its initially scheduled time (including even after the Court has announced its decisions). IT IS FURTHER ORDERED that on or before July 1, 2022, each party in each of the above-captioned actions shall file a letter that includes responses to the following questions, of no more than two paragraphs per question: (1) Which Supreme Court or Federal Circuit case is most similar to the challenged claim(s)? That is, each party is to identify which case provides the best analogy if this Court is to compare the claim(s) at issue in the relevant Section 101 Motion to claims previously found to be patent (in)eligible by a higher court.; (2) How do you reconcile the fact that to avoid being an abstract idea, a claim must not be to a "disembodied concept" and instead must be to a concept tethered to "real-world application[,]" see CLS Bank Int'l v. Alice Corp. Pty. Ltd., 717 F.3d 1269, 1286 (Fed. Cir. 2013) (Lourie, J., concurring) (internal quotation marks and citations omitted), but on the other hand, just because a claim might include a large number of concrete, tangible components, that does not necessarily mean that the claim is not abstract, see Yu v. Apple, Inc., 1 F.4th 1040, 1042-45 & n.2 (Fed. Cir. 2021); see also In re TLI Commc'ns LLC Pat. Litig., 823 F.3d 607, 611 (Fed. Cir. 2016)? In other words, what is your view about what it means for a claim to have a sufficient "real-world application" in the Section 101 context?; (3) When a court is figuring out what a claim is "directed to," what are the permissible tools that the court can use as part of that analysis?; (4) How is the "conventionality" analysis in Section 101 law different from that in a Section 102/103 analysis? IT IS FURTHER ORDERED that at the same time that the parties submit to the Court versions of any slides or other demonstrative materials they will use at the hearing (i.e., by no later than 4:00 p.m. on Wednesday, July 6, 2022), the parties shall also advise the Court and opposing counsel which attorney(s) will argue each motion. ORAL ORDER: The Court, having reviewed the parties' September 29, 2022 letter regarding the October 14, 2022 Markman hearing, (D.I. 74 in Civil Action No. 21-1117-MN-CJB), HEREBY ORDERS as follows: (1) The Court hereby allocates two hours for argument, to be split equally between the parties.; (2) With respect to the order of the terms and which side will present argument first for each term, the parties will present the terms in the order that they appear in the Joint Claim Construction Brief, with Defendant presenting all terms first.; (3) On or before October 7, 2022, local and lead counsel for the parties shall meet and confer and file an amended joint claim construction chart that sets forth the terms/issues that remain in dispute. The meet and confer shall focus on an attempt to reach agreement on any remaining disputed terms/issues where possible and on an attempt to focus the dispute over the remaining terms/issues in light of the parties' claim construction briefing. Accompanying any amended joint claim construction chart, the parties shall file a letter with the Court identifying by name each individual who participated in the meet and confer, when and how that meet and confer occurred and how long it lasted. If no agreements on constructions have been reached or if no dispute has been narrowed on the meet and confer, the letter shall so state and the parties need not file an amended joint claim construction chart.; (4) For administrative purposes, by no later than October 7, 2022, each party shall file a "Motion for Claim Construction" that requests the Court to adopt the claim construction position(s) of that party set forth in the Joint Claim Construction Chart and their briefing. The motion shall not contain any argument and shall simply state that the party "requests that the Court adopt the claim construction position[s] of [the party] set forth in the Joint Claim Construction Chart and its briefing."; (5) The Court is anticipating that the Markman hearing will be held in-person, and if so, the hearing will be held in Courtroom 6C. That said, in the parties' October 7, 2022 letter, they should also let the Court know if there is joint agreement to conduct the Markman hearing via videoconference. If there is joint agreement, the Court will do so; if there is not joint agreement, then the hearing will go forward as an in-person hearing in Courtroom 6C.; and (6) The parties should let the Court know in the October 7 letter whether a newer attorney will be arguing any of the claim terms at issue, see the Court's Standing Order Regarding Courtroom Opportunities for Newer Attorneys, http://www.ded.uscourts.gov/sites/ded/files/forms/StandingOrder2017.pdf. If the Court is aware that a newer attorney is going to argue a term/terms, it will make sure there is sufficient argument time for those term/terms, regardless of the time limits for the hearing set out above.Ordered by Judge Christopher J. Burke on 9/30/22. Associated Cases: 1:21-cv-01117-MN-CJB, 1:21-cv-01119-MN-CJB, 1:21-cv-01120-MN-CJB(mlc) (Entered: 09/30/2022)
