ORAL ORDER by Judge Leonard P. Stark on 7/23/2015: Having reviewed the parties letters and related materials (D.I. 46, 47, 49, 50), IT IS HEREBY ORDERED that Yodlees requested relief is GRANTED and Plaids requested relief is DENIED. Yodlee has met its burden of adequately identifying the accused products, yet Plaid has failed to provide core technical documents sufficient to show how the accused products work. Under the circumstances, which include that the patented technology purportedly relates to interactions that are not customer facing, Yodlee has made a persuasive showing that documents sufficient to show how the accused products work will require production of some amount of sourcecode (to show, e.g., how the accused products collect user data from websites, format and/or convert user data, and categorize user transaction data). The Court is not persuaded by Plaids contentions that doing so at this time (i.e., during the pendency of a motion to dismiss) and in the manner contemplated by the (stipulated) protective order is unfairly prejudicial or otherwise unwarranted. Accordingly, (1) Plaid shall produce documentation showing how Plaids Connect and Auth products work, including, if necessary, producing its source code; and (2) Yodlee is granted leave to amend its initial infringement contentions, including amending its election of 49 claims, provided that Yodlee does so within thirty (30) days after Plaid complies with the preceding portion (i.e., (1)) of this Order. The parties SHALL ADVISE the Court by joint letter no later than July 28 whether they agree if the date by which Plaid must provide its invalidity contentions should be changed, in light of todays Order. The teleconference scheduled for tomorrow is CANCELLED. (nmfn)
