ELECTRONIC NOTICE of Hearing. Markman Hearing set for 10/21/2014 10:00 AM in Courtroom 11 before Judge Denise J. Casper. After considering the matter of scheduling in this case further (and being aware of the schedule already set in 13-cv-11570-RGS), the Court enters this further ORDER regarding scheduling in this matter. The Court agrees that the pre-claim construction schedule and claim construction schedule should at least be in sync with the other Zond patent cases now pending in this district. As counsel made the Court aware, Judge Stearns has set a Markman hearing in his matter (involving 7 of the 10 patents in this case) for August 14, 2014. Accordingly, this Court will adopt the proposed schedule reflected on pages 14-15 of D. 19, as proposed by the Defendant in the parties' joint statement with one exception. A Markman hearing will not held in this matter on August 14, 2014, but instead will be held on October 21, 2014 at 10AM to allow the parties and the Court time to review any rulings from the August Markman hearing in 13-cv-11570-RGS prior to this hearing. If the parties would like the opportunity to file any briefing after any Markman ruling in 13-cv-15570, but prior to the October hearing before this session on the Court, they may jointly seek an amendment to this scheduling order to do so.(Hourihan, Lisa) (Entered: 12/17/2013)

Having considered Gillette's motion to file a supplemental brief, D. 172, and Zond's opposition to same, D. 173, the Court ALLOWS the motion and the Court has considered D. 172-1 in the resolution of Gillette's motion for attorneys' fees and costs. Judge Denise J. Casper: ELECTRONIC ORDER entered re: 138 Motion for Attorney Fees and Costs. With the IPR and appeals process complete, all claims of the patents-in-suit have been adjudicated as invalid. D. 136 at 2. Accordingly, the parties agree that there are no valid claims left for the Court to adjudicate and the only issue that remains is the attorneys' fees and costs sought by Defendants Gillette Co. LLC and the Procter & Gamble Co. ("Gillette"), D. 138, and opposed by Plaintiff Zond LLC ("Zond"), D. 145. After having reviewed and considered the extensive briefing by either side regarding same (including motion papers, opposition, reply brief, surreply brief and supplemental filings and supporting exhibits), the Court rules as follows and DENIES Gillette's motion for attorneys' fees and costs.Gillette seeks attorneys' fees under 35 U.S.C. § 285 which allows the recovery of reasonable attorneys' fees to the prevailing party in "exceptional cases." A case is "exceptional" if, for example, it "stands out" due to the "substantive strength" of a party's position or the "unreasonable manner" in which a party litigates a case. Octane Fitness, LLC v. ICON Health & Fitness, Inc., 572 U.S. 545, 554 (2014). In making this determination, the Court may consider the totality of circumstances and considering whether non-prevailing party's litigation conduct was objectively unreasonable or frivolous, whether its motivation for litigation was improper and whether the award of reasonable fees would to advance considerations of compensation and deterrence. Id. at 554 n.6 (citing Fogerty v. Fantasy, Inc., 510 U.S. 517 (1994)).As an initial matter, the Court must determine if Gillette was the prevailing party in this case. In the face of Gillette's motion for summary judgment on non-infringement, D. 60, Zond agreed to withdraw its claims for alleged infringement of its ten patents-in-suit by Gillette's consumer razor blades. D. 77. Pursuant to this stipulation and based upon the representations that Gillette's "magnetron sputtering methods and systems used to manufacture its commercial razor blades" were as explained in its discovery and as incorporated into the stipulation, D. 77 at 1-2, Zond agreed to "withdraw[] its claims that Gillette's Commercial Razor Blades infringe the Patents-in-Suit" and such withdrawal was with prejudice, D. 77 at 2, "and the parties stipulate[ed] to the dismissal of such claims with prejudice." Id. Although the stipulation sought the endorsement of the Court, D. 77 at 3, no such endorsement was required, Fed. R. Civ. P. 41(a)(1)(A)(ii), and the Court did not endorse the parties' stipulation. D. 164 at 10 n. 3. In the stipulation, both parties maintained their other claims and defenses including "any claims and defenses related to infringement or non-infringement of the Patents-in-Suit based upon Gillette's research and development activities," id., and "any claims and defenses related to costs and/or fees." Id. That is, as expressly provided in the stipulation, Zond's claims as to Gillette's commercial razor blades were dismissed with prejudice, but the parties agreed and contemplated that the remainder of the case as to Gillette's alleged infringement of the patents-in-suit by its research razors. Whether the parties' stipulation is characterized as a voluntary dismissal under Fed. R. Civ. P. 41(a)(1)(A)(ii), or not, the parties' stipulation to dismissal of such claims, D. 77 at 2, even with prejudice, does not bear the "necessary judicial imprimatur" to equate such agreement with an adjudication on the merits. For this reason, Gillette's reliance upon Raniere v. Microsoft Corp., 887 F.3d 1298 (Fed. Cir. 2018) does not aid its contention since there the "district court's dismissal with prejudice of [appellant's] action [for lack of standing] gave appellee the full relief to which they were legally entitled." Id. at 1307-08. That is, even if a court's dismissal was based upon a jurisdictional defect, and not the merits, the victor would be a prevailing party for the purposes of § 285, but still the critical issue is the imprimatur of the Court, not required or given in this case. See D. 173 at 4-5.Although the initial stipulation of the parties, D. 77, did not make Gillette a prevailing party in this case, certainly, as to the ten patents-in-suit that were the subject of the IPR proceedings (and, to those patents appealed, the subject of Federal Circuit review), Gillette was the prevailing party and would be for the purposes of a final judgment at this juncture, D. 164 at 6 n. 3. Accordingly, for the purposes of resolving the present motion, the Court assumes arguendo that Gillette was prevailing party for the consideration of whether the award of attorneys' fees and costs is warranted under § 285.The Court, however, does not conclude that this is an "exceptional" case under § 285 that warrants the shift of the attorneys' fees of the victor, Gillette, to the losing party, Zond. Although Gillette complains that the substantive strength of Zond's position as to its claims regarding its commercial razor blades was relatively weak from the outset, its focus is on whether Zond's continuation of its lawsuit was unreasonable. Accordingly, Gillette seeks attorneys' fees and costs for discovery as to the commercial razor blades once it contends that it was clear that its manufacture of same did not infringe; for its summary judgment motion regarding non-infringement of same; and for the IPRs that, as Gillette contends, were necessitated by Zond's refusal to drop this case. D. 164 at 17.As to the first category regarding non-infringement, Gillette contends that from the outset of this litigation initiated by Zond, it informed Zond and provided discovery evidencing that "Gillette's commercial razor blades are not manufactured using pulsing or the process described in the '909 patent." D. 141 at 12. Zond disputes that Gillette provided sufficient discovery early in the litigation to support its claim that its razor blades did not infringe Zond's patents-in-suit. D. 153 at 15. It is undisputed, however, that by Dr. Sonnenberg's deposition, Zond received "affirmative statements and/or testimony that Gillette did not use Zond's technology." D. 153 at 15. Moreover, not long after the Dr. Sonnenberg deposition on April 2, 2014, and on the heels of Gillette's May 1, 2014 motion for early summary judgment on non-infringement of Zond's ten patents-in suit as to "all of their commercial razor blades," D. 60 at 1; D. 141 at 12, Zond stipulated to the dismissal, with prejudice, of the claims against Gillette's commercial razor blades. D. 77 at 1 (filed May 6, 2014). At what point Gillette's early discovery production sufficiently rebutted Zond's pre-suit investigation at least as to the company not using any infringing technology to manufacture its razors is not clear, particularly where, for one example, Zond contends that the time frame in which Gillette was using its current manufacturing processes was not clear. D. 153 at 21-22 (and exhibits cited). Moreover, the Court agrees with Zond's point that the focus under Section 285 is on the exceptional "case," and not individual contentions or claims. See D. 170 at 10-11. That is, viewed in the totality of circumstances, the Court cannot say that Zond's continuation of its claims regarding commercial razor blades, see D. 1 at ¶ 23 et seq., was unreasonable through the parties' May 6, 2014 stipulated dismissal of same when Zond had a plausible basis for the initiation of its claims and given the disputes between the parties about the sufficiency of early discovery on this point. This is particularly true where, even by Gillette's accounting, the parties' negotiations regarding the stipulated dismissal of these claims began after Dr. Sonnenberg's April 2, 2014 deposition and culminated, a little over a month later, in their stipulation. As to the filing of Gillette's summary judgment motion, by both parties' timelines, they were engaged in the negotiations about the stipulation when Gillette chose to file its summary judgment motion, ahead of any deadline to do so. Although Gillette's strategy in filing the motion, D. 60, may well have worked in pushing those negotiations to their consummation given the stipulation filed less than a week later, D. 77, the Court does not conclude that Zond's conduct unreasonably necessitated such filing. Finally as to the fees and costs related to the IPR proceedings, although Gillette succeeded on all of its claims before PTO (and, as to some, before the Federal Circuit), the Court does not conclude that Zond's conduct in response was unreasonable. The parties' stipulation contemplated, from both sides, that the litigation was narrowed, but would continue as to Zond's claims regarding infringement by Gillettes research razors. D. 77 at 2. That Gillette chose the defensive strategy of seeking IPRs as to all of the claims arising from the ten patents-in-suit, D. 141 at 13 was not unreasonable, but neither was Zond's initial opposition to the motion to stay, D. 85 (citing prejudice to Zond from the timing of Gillette's IPR filings), later withdrawn, D. 119, regarding same or Zond's defense of those matters before the PTO.Having concluded that this is not an exceptional case for the purposes of § 285, leave to allow the filing supporting documents and affidavits regarding the specific scope of same as sought by Gillette, D. 141 at 23, is not warranted. To the extent that Gillette was also seeking attorneys' fees and costs under 28 U.S.C. § 1927, D. 141 at 5, the Court denies such relief. Where recovery of fees and expenses under § 1927 is reserved for those "who so multiples the proceedings in any case unreasonably and vexatiously may be required by the court to satisfy personally the excess costs, expenses and attorneys' fees reasonably incurred because of such conduct," 28 U.S.C. § 1927, the Court declines to award same for the same reasons as articulated as to the denial of § 285 fees as noted above. See Goss Int'l Americas, Inc. v. MAN Roland, Inc., No. 03-cv-513-SM, 2008 WL 879761, at *6 (D.N.H. Mar. 28, 2008).For all of these reasons, the Court DENIES Gillette's motion for attorneys' fees and costs, D. 138. (Hourihan, Lisa) (Entered: 04/24/2019)
